Booking Terms and Conditions

StreetSafe Driving School Limited

These Terms and Conditions apply to all driving lesson bookings, intensive courses, Pass Plus courses, test support, and related services arranged through StreetSafe Driving School Limited.

By making a booking, paying a reserve/deposit, accepting a lesson date, or using our services, you agree to these Terms and Conditions.

1. Definitions

In these Terms:

“StreetSafe”, “we”, “us” or “our” means StreetSafe Driving School Limited.

“Student”, “you” or “your” means the person receiving driving tuition or, where the student is under 18, their parent or legal guardian.

“Instructor” means the self-employed Approved Driving Instructor, Potential Driving Instructor, or other suitably qualified driving instructor allocated to provide driving tuition.

“Initial Payment” means the booking, administration, assessment, course arrangement, or placement/ reserve fee paid to StreetSafe when a booking is made.

“Lesson Fees” means the money payable for practical driving tuition after the booking has been confirmed.

“Course” means any driving lesson package, intensive course, Pass Plus course, test preparation package, or other tuition arrangement.

2. Who You Are Contracting With

StreetSafe Driving School Limited provides booking, administration, student support, course coordination, instructor allocation, and related services.

Driving lessons are delivered by self-employed instructors. Unless expressly stated otherwise in writing, your practical driving tuition is provided by the allocated instructor as an independent self-employed professional.

StreetSafe is responsible for the services it directly provides, including booking administration, course coordination, student communication, and reasonable care in allocating instructors.

The instructor is responsible for providing the driving tuition, managing the vehicle during lessons, assessing your driving ability, and delivering lessons safely and professionally.

3. Booking Process

To book lessons or a course, you may be required to:

  1. provide your full name, address, contact details, date of birth, driving licence details, and availability;
  2. confirm your driving experience and any relevant medical or learning needs;
  3. make the Initial Payment to StreetSafe;
  4. attend any pre-acceptance assessment required by StreetSafe or the instructor;
  5. agree a lesson schedule with StreetSafe and/or the instructor.

A booking is not confirmed until StreetSafe has accepted the booking and received the required Initial Payment.

StreetSafe may refuse or cancel a booking where it reasonably believes the course is unsuitable, the student is not legally entitled to drive, the student has provided inaccurate information, or no suitable instructor is available.

4. Initial Payment to StreetSafe

The Initial Payment is paid to StreetSafe for booking administration, course planning, student onboarding, instructor allocation, assessment arrangements, and related support.

Subject to your statutory rights and UK consumer law, the Initial Payment is non-refundable once StreetSafe has begun providing these services.

This means that if you cancel after StreetSafe has started work on your booking, StreetSafe may retain a fair and reasonable amount to reflect the work carried out, costs incurred, and losses suffered.

Nothing in these Terms affects your legal rights under UK consumer law, including any cancellation rights that may apply to online, telephone, or off-premises bookings.

5. 14-Day Cancellation Rights for Online, Telephone, or Off-Premises Bookings

Where you book with StreetSafe online, by telephone, by email, or away from our business premises, you may have a legal right to cancel within 14 days of entering into the contract.

If you ask us to start providing services during the 14-day cancellation period, you agree that we may begin work immediately. If you later cancel within the 14-day period, you may be required to pay for the services already provided up to the point of cancellation. UK guidance confirms that service contracts arranged online, by phone, or by mail order usually have a 14-day cooling-off period, and if the consumer asks for the service to start during that period, they can still cancel but may have to pay for the value of services already provided.

If the service has been fully performed within the 14-day period with your express agreement, you may lose the right to cancel once the service has been completed.

To cancel, you must contact StreetSafe in writing by email.

6. Payments to the Instructor

After the Initial Payment has been made to StreetSafe, all remaining lesson fees, unless otherwise agreed in writing, are payable directly to the allocated self-employed instructor.

The instructor will confirm their payment terms, lesson rates, cancellation policy, accepted payment methods, and any payment deadlines.

StreetSafe does not hold lesson fees paid directly to the instructor and is not responsible for refunds of money paid directly to the instructor, except where StreetSafe has expressly agreed otherwise in writing.

Any dispute about lesson fees paid directly to the instructor should first be raised with the instructor. StreetSafe may assist with communication where appropriate but is not automatically liable for sums paid directly to the instructor.

7. Lesson Prices and Course Prices

Lesson and course prices will be confirmed before booking.

Prices may vary depending on location, instructor availability, lesson type, vehicle type, course intensity, and whether the booking includes test-day support, mock tests, Pass Plus, motorway tuition, or other additional services.

StreetSafe and/or the instructor may correct obvious pricing errors before a booking is confirmed.

Once a booking has been confirmed, prices will not normally change unless:

  1. you change the course or lesson requirements;
  2. additional lessons are needed;
  3. your test date changes;
  4. you request a different instructor, vehicle, location, or schedule;
  5. the instructor’s standard rates change for future, unbooked lessons.

8. Intensive Courses

An intensive course is designed to help students progress quickly, but StreetSafe does not guarantee that any student will pass their driving test.

Driving ability, confidence, consistency, test readiness, nerves, road conditions, examiner decisions, and DVSA test availability are outside StreetSafe’s control.

Before accepting a student onto an intensive course, StreetSafe or the instructor may require a pre-acceptance assessment. This is to assess suitability and help determine whether the proposed course length is realistic.

StreetSafe focuses on safe driving, not simply fast test preparation. If, in the instructor’s professional opinion, the student is not ready for test, the instructor may recommend postponing the test or taking additional lessons.

9. Driving Tests and Test-Day Support

Where a course includes practical test support, this may include use of the instructor’s car for the driving test, a pre-test lesson, and support on the day of the test. There may be an additional cost on top of the standard course payment.

Use of the instructor’s car for the test is always subject to the instructor’s professional judgement. The instructor may refuse use of the car if they reasonably believe:

  1. the student is unsafe;
  2. the student is not test-ready;
  3. the student is unfit to drive;
  4. the student does not hold a valid licence;
  5. the vehicle would be at risk;
  6. the student’s behaviour creates a safety concern.

StreetSafe and instructors do not control DVSA test availability, test cancellations, examiner decisions, weather-related disruption, traffic conditions, or test-centre issues.

If the DVSA cancels or changes a test, any rearranged lessons or test-day support will be subject to instructor availability and may incur additional charges.

10. If You Fail Your Driving Test

StreetSafe does not guarantee a pass.

If you fail your test, the instructor will provide feedback on the result and areas for improvement. Where appropriate, StreetSafe may also provide feedback to the student and, where agreed, to the parent or guardian.

Additional lessons, further test preparation, and future use of the instructor’s car for another test are not included unless expressly agreed.

Any further lessons or test support will be charged at the instructor’s applicable rate unless StreetSafe has agreed a different arrangement in writing.

11. Lesson Cancellation by the Student

The instructor’s cancellation policy will apply to lessons booked directly with the instructor.

Unless the instructor confirms otherwise, you must give at least 48 hours’ notice to cancel or rearrange a lesson.

If you give less than the required notice, the instructor may charge the full lesson fee.

The instructor may waive a cancellation charge at their discretion in exceptional circumstances, but they are not required to do so.

Repeated cancellations may result in the instructor or StreetSafe ending the booking.

12. Lesson Cancellation by the Instructor

The instructor may cancel or rearrange a lesson where necessary due to illness, vehicle issues, unsafe weather, traffic disruption, emergency, test commitments, or other reasonable circumstances.

Where the instructor cancels a lesson, the instructor will usually offer an alternative date or time.

StreetSafe is not responsible for loss of earnings, travel costs, childcare costs, test fees, or other indirect losses caused by lesson cancellation or rearrangement, except where the law does not allow such liability to be excluded.

13. Student Responsibilities

You must:

  1. hold a valid UK provisional or full driving licence, as applicable;
  2. bring your licence to lessons if requested;
  3. be legally entitled to drive;
  4. be fit to drive;
  5. wear suitable footwear and clothing;
  6. tell the instructor about any medical condition, medication, disability, anxiety, learning need, or other issue that may affect driving;
  7. follow the instructor’s reasonable safety instructions;
  8. behave respectfully towards StreetSafe staff, instructors, examiners, and other road users;
  9. not attend lessons under the influence of alcohol, drugs, or any medication that may impair driving.

The instructor may end a lesson immediately if they believe you are unsafe, unfit to drive, abusive, aggressive, under the influence, or otherwise unsuitable to continue.

In such cases, the lesson fee may still be payable.

14. Fitness to Drive

You are responsible for ensuring that you are fit to drive before each lesson.

You must not drive if you are affected by alcohol, illegal drugs, prescription medication, tiredness, illness, injury, poor eyesight, or anything else that could affect your ability to drive safely.

You must meet the legal eyesight standard for driving.

If you are unsure whether you are fit to drive, you must tell the instructor before the lesson starts.

15. Instructor Allocation

StreetSafe will use reasonable care when allocating an instructor.

Instructor allocation depends on availability, location, course type, student needs, vehicle type, and scheduling.

StreetSafe may change the allocated instructor where reasonably necessary.

You may request a different instructor, but StreetSafe cannot guarantee that an alternative instructor will be available.

16. Instructor Status

Instructors working with StreetSafe are self-employed unless expressly stated otherwise.

They are responsible for their own tax, National Insurance, professional registration, vehicle, insurance, lesson delivery, and tuition standards.

StreetSafe is not responsible for the instructor’s acts or omissions except where StreetSafe is legally responsible or has failed to exercise reasonable care in the services it provides.

Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded.

17. Liability

StreetSafe does not exclude or limit liability for:

  1. death or personal injury caused by its negligence;
  2. fraud or fraudulent misrepresentation;
  3. breach of your statutory rights where liability cannot legally be excluded;
  4. anything else that cannot legally be excluded under UK law.

Subject to the above, StreetSafe is not liable for:

  1. tuition services provided directly by a self-employed instructor;
  2. payments made directly to an instructor;
  3. DVSA test availability, cancellations, delays, or examiner decisions;
  4. failure to pass a driving test;
  5. loss of earnings, loss of opportunity, travel costs, childcare costs, or other indirect losses;
  6. delays caused by weather, traffic, vehicle faults, illness, or events outside reasonable control.

StreetSafe’s liability for its own services is limited to the amount of the Initial Payment paid to StreetSafe, unless the law requires otherwise.

18. No Guarantee of Test Pass

StreetSafe and its instructors will provide tuition, guidance, support, and feedback with reasonable care and skill.

However, no guarantee is given that a student will pass a driving test, reach test standard within a particular number of lessons, or be ready by a specific date.

Any estimated number of lessons is a guide only.

19. Pass Plus and Additional Courses

Pass Plus and other post-test courses may be offered as optional add-ons.

Pass Plus is designed to provide additional real-world driving experience after passing the practical test, including areas such as motorway driving, night driving, rural roads, dual carriageways, town driving, and all-weather driving where possible.

Any insurance discount linked to Pass Plus is decided by insurers and is not guaranteed by StreetSafe.

Any available grant from Hampshire council must be applied for by the student.

20. Parent or Guardian Involvement

Where a student is under 18, a parent or legal guardian must agree to these Terms and may be responsible for payment.

StreetSafe and/or the instructor may provide progress updates to parents or guardians where appropriate and where consent has been given.

StreetSafe’s approach is to support both the student and family by providing constructive feedback, especially around safety, confidence, readiness, and next steps.

21. Complaints

If you are unhappy with any part of the service, you should first raise the issue with the instructor where it relates to lesson delivery.

If the issue is not resolved, or if it relates to StreetSafe’s booking or administration service, you should contact StreetSafe in writing.

StreetSafe will aim to investigate complaints fairly and respond within a reasonable time.

Where appropriate, StreetSafe may speak to the instructor, review booking information, and suggest a practical resolution.

22. Behaviour and Respect

StreetSafe expects students, parents, guardians, instructors, and staff to communicate respectfully.

Abusive, threatening, discriminatory, aggressive, or inappropriate behaviour may result in immediate termination of the booking.

Where a booking is terminated due to unacceptable behaviour, no refund will be due for services already provided or costs already incurred.

23. Data Protection

StreetSafe will collect and process personal information for the purpose of managing enquiries, bookings, course administration, instructor allocation, payments, student support, safety, and legal compliance.

Personal information may be shared with the allocated instructor where necessary to provide the service.

StreetSafe will handle personal data in accordance with applicable UK data protection law.

A separate Privacy Policy may be provided on the StreetSafe website.

24. Photos, Videos, Reviews, and Marketing

StreetSafe will not use a student’s photograph, video, name, testimonial, or review for marketing purposes without appropriate consent.

Separate consent may be requested for website, social media, advertising, or promotional use.

Students and parents are not required to give marketing consent as a condition of taking lessons.

25. Changes to These Terms

StreetSafe may update these Terms from time to time.

The Terms in force at the time of your booking will normally apply to that booking unless a change is required by law or is clearly beneficial to the student.

26. Events Outside Our Control

StreetSafe and instructors are not responsible for delays or failure to provide services caused by events outside reasonable control, including severe weather, illness, vehicle breakdown, road closures, DVSA disruption, test-centre cancellations, accidents, emergencies, government restrictions, or other events beyond reasonable control.

Where possible, affected lessons will be rearranged.

27. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes will be subject to the courts of England and Wales, unless consumer law gives you the right to bring proceedings elsewhere.

Acceptance of Terms

By ticking the box marked “I have read and agree to the StreetSafe Driving School Limited Booking Terms and Conditions”, submitting a booking form, making a payment, or proceeding with a booking, you confirm that:

  1. you have been given the opportunity to read these Booking Terms and Conditions before booking;
  2. you understand that these Terms and Conditions apply to your booking;
  3. you agree to be legally bound by these Terms and Conditions;
  4. all information you provide during the booking process is accurate and complete;
  5. where the student is under 18, the parent or legal guardian completing the booking has authority to accept these Terms and Conditions on the student’s behalf;
  6. you understand that the Initial Payment paid to StreetSafe relates to booking administration, course coordination, student onboarding and instructor allocation;
  7. you understand that, subject to your statutory rights and UK consumer law, the Initial Payment may be non-refundable once StreetSafe has started providing those services;
  8. you understand that remaining lesson fees may be paid directly to the allocated self-employed instructor, unless agreed otherwise in writing.
